Can I be evicted for dog mess even if there's no proof?
We live in a medium sized apartment complex. Our particular unit sits in the most heavily trafficked (foot traffic and car traffic) area of the property. At the beginning of our lease, due to MAJOR repairs not being fixed, we were forced to put our rent money in escrow. Our problems were eventually resolved.
We have two dogs. They potty outside. However, even though we clean up the mess, there are often piles of feces in front of our apartment due to various other tenants walking their dogs in this high traffic area, and neglecting to clean up after their dogs. On several occasions, I have had to go out and clean these messes myself because the smell has gotten so bad. However, I do not feel that it is our responsibility to clean this.
Now that we’ve been living here for six months, over the past two weeks we’ve gotten notices that we need to clean the dog feces. I have done this consistently and these are the first notices we’ve gotten. On the second notice, they are now threatening eviction. I don’t see how this is possible and feel that it might even be retaliation for our adamancy that they make repairs to our apartment.
Any ideas?
Its every dog owners responsibility to pick up after their own dog.
I don’t know your apartments rules, but you may be responsible for keeping the "area" around your "unit" clean also of poop, paper, random crap the wind blows onto your "area" that includes other dogs.
So, they may technically be right that other dogs poop on your area is your responsibility.
I once grabbed someone’s dog poop freshly dropped and walked up to them after they walked away without picking it up and said "you do this again, and I will shove this sh** right down your f’in throat"
I picked it up bare hand in front of my townhouse in NYC. They knew I was serious believe me. They were really embarrassed and very frightened.

Eviction is a judicial process. Once the proceeding begins, you will have to appear and file an answer that includes your defenses and any counterclaims. It is important that you do this, or you will be summarily evicted (in most states).
At the following judicial proceeding, your landlord can present evidence and so can you. If the evidence supports a finding of retaliatory eviction, you can obtain attorney fees and damages–maybe even punitive damages depending upon your jurisdiction.
As for cleaning up dog feces, this will depend upon your lease requirements. As the other answer suggests, you may well have a contractual obligation to pick up other dog owners’ poop that is in your yard. Otherwise, you will have to rebut your landlord’s evidence that the poop is from your dog. You might want to keep your camera next to the window, and secure a few photos of neighbors’ dogs pooping in your yard. Testimony from knowledgeable neighbors will also help.
Legal disputes are resolved with evidence. Get some.

Best idea. Move.
Second best idea. Get rid of the dogs. Move.
Third best idea. When You own the property, have all the dogs you want. Until then keep paying rent.

Write a letter back to them explaining that you not only clean up after your dog, you have at times cleaned up after other peoples’ dogs, and that you believe the notices are retaliation for your previous repair dispute. Keep a copy of your letter.
They can still try to evict you but at least you’ll have documented proof that you told them to back off.
And, as disgusting as it may seem, it might help if you took pictures every day of you cleaning up your dog’s messes. And if you can take a picture of other tenants not cleaning up after their dogs that might help too.
